The following Terms and Conditions are for our partner travel agency, AmFund (dba Golden Pear Travel). They are general terms to the travel agency. 1. Scope of Agreement & Role of Agency By booking travel services through Golden Pear Travel (hereafter referred to as “the Agency”), the traveler acknowledges and agrees to these Terms and Conditions, which constitute a binding contract. The Agency acts solely as an intermediary between travelers and independent suppliers, including but not limited to airlines, hotels, cruise lines, tour operators, and transportation providers (collectively, “Suppliers”). The Agency does not own, operate, or control these Suppliers and assumes no liability for their acts, errors, omissions, delays, or any losses or damages incurred due to their services. Travelers understand and accept that all bookings are subject to the terms and conditions of the individual Suppliers, which may include restrictions, limitations, and penalties. 2. Booking, Payments & Cancellations All reservations require a deposit or full payment as outlined in each Supplier’s policies. Prices are subject to change until payment is made in full. All rates are subject to change based on fluctuations in exchange rate. The Agency reserves the right to correct any errors in pricing. Travelers acknowledge that airline tickets, cruises, tours, and accommodations may be non-refundable and subject to change or cancellation fees as determined by the Supplier. The Agency reserves the right to charge service fees for trip planning, modifications, or cancellations, which are non-refundable under any circumstances. If a Supplier cancels or alters a booking, any compensation or refund is at the Supplier’s discretion. The traveler agrees to comply with all deadlines and documentation requirements. The Agency reserves the right to assess cancellation fees in addition to the supplier’s cancellation fees. 3. Travel Documentation & Responsibility of Travelers It is the sole responsibility of the traveler to obtain and carry the necessary travel documents, including valid passports, visas, and any required vaccinations. The Agency is not responsible for a traveler’s failure to possess proper documentation or for any resulting costs or trip interruptions. Minors traveling without both parents or legal guardians may need additional notarized documentation as per destination requirements. Failure to present proper identification or travel documents may result in denied boarding or entry, for which the Agency bears no responsibility. If the Agency booked your airline tickets, those airline tickets are often 100% non-refundable and subject to individual airline penalties/fees to make changes to them. Once your reservation is confirmed, additional penalties may be assessed by the Agency in addition to any additional airline penalties per person, per ticket. Please note: Airline e-tickets, future travel credits or travel vouchers do have an expiration date and must be used prior to that date. If your trip is cancelled for any reason, the airline will decide how you are compensated. Please be aware of Department of Transportation guidelines that keep these airlines accountable. The Agency cannot advise of any decisions to be made. If arrival time designated by an airline is missed, the airline reserves the right to re-book your flight or cancel it. Please make proper arrangements to arrive at the airport at least 2 hours prior to departure for domestic travel or 3 hours for international travel. 4. Travel Risks, Insurance & Limitation of Liability Travel involves inherent risks, including but not limited to changes in travel restrictions, health advisories, acts of God, pandemics, civil disturbances, terrorism, extreme weather, and Supplier insolvency. The Agency strongly recommends purchasing comprehensive travel insurance to protect against unforeseen events, cancellations, medical expenses, and travel disruptions. The traveler acknowledges that the Agency has no control over these risks and agrees to release and hold the Agency harmless from any claims, losses, injuries, or damages resulting from such occurrences. 5. Dispute Resolution & Governing Law Any disputes arising from this agreement, or breach thereof, the parties agree first to try in good faith to settle the dispute by mediation and or arbitration administered by a third party professionally licensed mediator in the State of Florida prior to any litigation. The traveler agrees to waive the right to participate in a class action lawsuit against the Agency. This agreement shall be governed by and interpreted under the laws of the State of Florida of the United Stated of America, and any legal proceedings must be filed in the jurisdiction of the Agency’s primary business location. 6. Severability & Final Agreement If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This agreement represents the entire understanding between the Agency and the traveler, superseding any prior discussions or communications. No modifications shall be valid unless agreed to in writing by both parties. By booking with the Agency, the traveler acknowledges that they have read, understood, and agreed to these Terms and Conditions. Payment of deposit or full payment shall be deemed as consent by the passenger to the above conditions. Golden Pear Travel is a subsidiary of Fundraising Travel Foundation, Inc, a registered seller of travel; registration number ST41653.
